1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Manabi ("we", "our", or "us"), operated by JOMos Sdn. Bhd., a company incorporated in Malaysia. By creating an account, accessing, or using the Manabi platform at manabi.jomos.com.my or any associated websites and mobile applications, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are under 18 years of age, you must have the consent of a parent or legal guardian to use this platform.

2. Description of Service

Manabi is an online question bank and practice platform designed for Malaysian students from secondary school through to university level. The platform provides access to practice questions, past-year exam papers, answer explanations, and related educational content covering examinations including PT3, SPM, STPM, MUET, and university entrance assessments.

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

3. User Accounts

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to terminate or suspend accounts that violate these Terms, contain inaccurate information, or have been inactive for an extended period.

4. Acceptable Use

You agree not to use Manabi to:

• Copy, reproduce, distribute, or commercially exploit any content without our express written permission
• Share login credentials with others or allow multiple users to share a single account
• Use automated tools, bots, or scripts to access, scrape, or download content
• Attempt to reverse-engineer, decompile, or otherwise tamper with any part of the platform
• Upload or transmit any malicious code, spam, or harmful material
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Engage in any activity that violates Malaysian law or the rights of others

5. Content & Intellectual Property

All content on Manabi — including but not limited to questions, answer explanations, graphics, logos, icons, and software — is the property of Manabi or its content licensors and is protected by Malaysian and international copyright laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the content solely for your personal, non-commercial educational purposes. This licence does not include the right to:

• Reproduce, duplicate, or copy content for redistribution
• Sell, resell, or commercially exploit any content
• Create derivative works based on our content without written consent

Past-year examination questions remain the intellectual property of their respective examination boards. Manabi provides these under fair use for educational purposes.

6. Subscriptions & Billing

Manabi offers both free and paid subscription tiers. For paid plans:

• Subscription fees are charged in Malaysian Ringgit (MYR) and are non-refundable except as required by Malaysian consumer protection law
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period
• We reserve the right to change subscription prices with 30 days' notice to registered users
• All prices are inclusive of applicable Malaysian taxes (SST) where required

7. Disclaimer of Warranties

Manabi is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• The platform will be uninterrupted, timely, secure, or error-free
• The results obtained from use of the platform will be accurate or reliable
• Any content on the platform is free from errors or omissions

While we strive to ensure the accuracy of all questions and answers, we make no guarantee that content is free from errors. Users should always cross-reference with official examination board materials.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law, Manabi and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of data, loss of profits, or examination results.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Manabi shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to Manabi at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us at enquiries@manabi.com.my. Upon termination, your right to use the platform ceases immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes by email or by displaying a prominent notice on the platform. Your continued use of Manabi after changes take effect constitutes your acceptance of the revised Terms.
